Terms and Conditions

1. Definitions

• "Host" means anyone who lists a place on the Site.
• "Guest" means anyone who uses the Site to find, ask about or stay at a listed place.
• "Listing" means the details, photos, price and other content a Host posts about a place.
• "User" means a Host or a Guest.
• "Stay" means any arrangement, booking, payment or dealing between a Host and a Guest, whether or not it started on the Site.

2. What Shoreline is

2.1 The Site shows Listings and lets Guests contact Hosts directly on WhatsApp. Shoreline is an intermediary, as defined under the Information Technology Act, 2000.

2.2 Shoreline doesn't take bookings or payments, doesn't own, manage, operate or rent any listed place, and is not a party to any Stay.

2.3 Shoreline is not an agent, broker, trustee, escrow holder, insurer or representative of any Host or Guest.

2.4 Every Stay is solely between the Host and the Guest. They agree all of its terms directly, including dates, price, deposit, check-in and check-out, house rules, cancellation and refunds.

3. How we review Listings

3.1 The Shoreline team reviews each Listing before it is published, and may mark a Host as "Verified" after carrying out its own checks on that Host.

3.2 These reviews and checks are limited. They are not an inspection of the place, a check of its legal permissions, or a guarantee of the Listing, the Host, the Guest or any Stay. Guests must still satisfy themselves about a place before agreeing a Stay (section 7).

3.3 We may decline, edit for clarity, pause or remove any Listing, and remove a "Verified" mark, at any time.

4. Who can use the Site

4.1 You must be at least 18 years old and able to enter a legally binding contract under the Indian Contract Act, 1872.

4.2 The Site has no accounts. Each Listing has a private link that lets anyone who has it edit the Listing. Hosts are responsible for keeping that link private and for any changes made through it. If it gets out, message us and we will replace it.

5. Payments

5.1 All money for a Stay, including rent, advance, deposit and any other charge, goes directly from the Guest to the Host. Shoreline doesn't collect, hold, process, transfer or refund any of it.

5.2 Shoreline doesn't charge Users any booking fee, commission, service fee or deposit for a Stay.

5.3 The Host and the Guest are solely responsible for agreeing how, when and how much to pay, for receipts, and for any taxes on the Stay, including GST where it applies.

5.4 Never send money to Shoreline, or to anyone claiming to act for Shoreline, for a Stay. If anyone asks you to, report it to us at once on WhatsApp (Message Shoreline).

5.5 Any non-payment, part-payment, late payment, overpayment, chargeback, refund dispute or forfeited deposit is strictly between the Guest and the Host. Shoreline will not mediate, collect, guarantee or compensate for any such amount.

6. Hosts' responsibilities

6.1 You confirm that you own the place, or are authorised by its owner to list and rent it.

6.2 You must keep your Listing accurate, current and not misleading, including its photos, amenities, capacity, location, price and house rules.

6.3 You are solely responsible for getting and keeping every licence, registration, permission and approval needed to host guests at the place, including any required under Karnataka tourism rules, local municipal or panchayat rules, coastal regulation zone rules, fire safety, police verification of guests and tax laws.

6.4 You are solely responsible for the safety, condition and legal compliance of the place, and for any harm or loss a Guest or anyone else suffers at or because of it.

6.5 You must reply to Guests in good faith and must not discriminate against any Guest on any unlawful ground.

7. Guests' responsibilities

7.1 You are responsible for reading the Listing, talking to the Host directly, and satisfying yourself about the place, its suitability, safety and price before agreeing a Stay.

7.2 You must treat the place with reasonable care, follow the Host's house rules and the law, and keep the number of guests within what you agreed with the Host.

7.3 You are solely responsible for any damage, loss, theft, nuisance or misuse caused to the place or its contents by you or anyone staying with you.

7.4 You are responsible for your own safety and that of anyone staying with you, including at beaches, in the sea, at pools and at other facilities at or near the place.

8. Disputes between Users

8.1 Any dispute between a Host and a Guest, including about payment, damage, cancellation, refunds, misrepresentation, injury, lost belongings, noise, overstay or behaviour, is to be resolved between them.

8.2 Shoreline has no obligation to investigate, mediate, arbitrate or resolve any such dispute and will not be a party to any proceeding between Users. Users agree not to join Shoreline to any such dispute.

8.3 Shoreline may, at its discretion, share a User's contact details with the other party where this helps resolve a dispute or where the law requires it.

9. Disclaimer

9.1 The Site and everything on it are provided "as is" and "as available". To the fullest extent the law allows, Shoreline gives no warranties, express or implied, including as to accuracy, reliability, quality, safety, legality, availability or fitness for a particular purpose.

9.2 Listings are written by Hosts and don't reflect Shoreline's views. Apart from the limited review described in section 3, Shoreline doesn't verify, endorse or guarantee any Listing, any User's identity or conduct, or the outcome of any Stay.

9.3 Shoreline doesn't guarantee that the Site will be uninterrupted, secure or free from errors, viruses or unauthorised access.

10. Limitation of liability

10.1 Shoreline acts only as an intermediary. To the fullest extent the law allows, Shoreline has no liability to any Host, Guest or third party for any loss, damage, cost, claim or expense arising from any Stay or from use of the Site.

10.2 Without limiting section 10.1, Shoreline is not liable for:

• non-payment, late payment, fraud, misappropriation or any payment dispute between Users;
• damage to, or loss or theft of, any property or belongings;
• personal injury, illness, death, accident or harm at or near a listed place, including on beaches or in the water;
• any inaccuracy, misrepresentation or omission in a Listing or in anything Users tell each other;
• any cancellation, no-show, double booking, refusal of entry or early end of a Stay;
• the acts, omissions or negligence of any User or anyone staying with them;
• any User's failure to comply with the law, including missing licences or permissions;
• any indirect, incidental, special, consequential or punitive loss, including loss of profit, revenue, goodwill or data;
• events beyond our reasonable control, including natural disasters, weather, tides, government action, strikes or the failure of third-party services such as WhatsApp.

10.3 Nothing in these Terms excludes or limits any liability that the law doesn't allow to be excluded or limited, including liability for fraud or wilful misconduct by Shoreline.

11. Indemnity

You agree to indemnify and hold harmless Shoreline and the people who run it against all claims, losses, liabilities, damages, penalties and expenses (including reasonable legal fees) arising from: (a) your use of the Site; (b) any Stay you are part of; (c) your breach of these Terms or of any law; (d) your Listing or other content; or (e) any claim by another User or a third party relating to you, anyone staying with you, or your place.

12. Content and conduct

12.1 Hosts keep ownership of the content they post, but give Shoreline a non-exclusive, worldwide, royalty-free licence to host, display, adapt (for example, resize or crop photos) and use it to run and promote the Site, for as long as the Listing is on the Site and for a reasonable period afterwards.

12.2 You must not post content that is false, misleading, defamatory, obscene, infringing or otherwise unlawful, or that breaks Rule 3 of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

12.3 You must not use the Site to commit fraud, ask for payments in Shoreline's name, scrape data, interfere with how the Site works, or impersonate anyone.

12.4 We may remove any content or restrict access to the Site at any time where we believe these Terms or the law are being broken, or where a court or competent authority requires it.

13. Privacy

Our Privacy Policy explains how we collect and use personal data, in line with Indian law including the Digital Personal Data Protection Act, 2023. It forms part of these Terms.

14. Intellectual property

The Shoreline name, logo, design, software and content of the Site (other than Users' content) belong to Shoreline or its licensors. You may not copy, change, distribute or exploit them without our written permission.

15. Other services

The Site links to services run by others, including WhatsApp. We don't control them and aren't responsible for their content, terms or practices.

16. Removing Listings and access

We may pause or remove a Listing, or restrict anyone's use of the Site, at any time, with or without notice, for a breach of these Terms or for any other reason the law allows. Hosts can pause their Listing at any time with their private link, or ask us to remove it. Sections 5, 8, 9, 10 and 11 continue to apply after a Listing is removed.

17. Governing law, arbitration and jurisdiction

17.1 These Terms are governed by the laws of India.

17.2 Any dispute between a User and Shoreline arising from these Terms will first be attempted to be resolved amicably. Failing that, it will be referred to a sole arbitrator appointed by mutual consent of Shoreline and the User, under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration will be Mangaluru, and the language English.

17.3 Subject to section 17.2, the courts at Mangaluru, Karnataka have exclusive jurisdiction.

18. Complaints and contact

For any complaint or concern, including under the Information Technology Act, 2000 and the rules made under it, message the Shoreline team on WhatsApp (Message Shoreline). We will acknowledge it within 24 hours and resolve it within the time the law requires.

19. General

19.1 Entire agreement: these Terms and the Privacy Policy are the entire agreement between you and Shoreline about the Site.

19.2 Severability: if any part of these Terms is found invalid or unenforceable, the rest continues in full force.

19.3 No waiver: not enforcing a right is not a waiver of it.

19.4 Assignment: you may not transfer your rights under these Terms. Shoreline may transfer its rights to a successor.

19.5 Changes: we may change these Terms by posting a new version on this page with a new "Last updated" date. Continuing to use the Site after a change means you accept the new version.
